Child Protection

Under the Children Youth and Families Act 2005 (CYFA), a child is deemed to need protection if any one of the following grounds is found:

  • abandonment

  • death or incapacity of a parent

  • physical injury, or risk thereof

  • sexual abuse, or risk thereof

  • emotional or psychological abuse, or risk thereof

  • neglect

Different types of Orders can be made in the Children’s Court to ensure the ongoing safety and wellbeing of a protected child. This includes temporary placement of a child with a suitable carer, or Orders that a parent refrains from doing certain behaviours.

The Department of Familes, Fairness, and Housing are responsible for applying to the Children’s Court for a child’s protection.
